EGR Warranty Policy for Direct Consumers

EGR has designed and manufactured your new product to be trouble-free subject to it being properly fitted, properly maintained, used for its intended purpose, unmodified, and treated with care.

If your new product is defective, EGR will repair or replace the product, at our discretion, as per the below term and conditions. This policy applies to all new products sold in Australia from 1 April 2021.

The warranty period offered for each EGR product is as per the table below:

Important Notice

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

This warranty policy does not limit the Australian Consumer Law statutory consumer guarantees in any way. In some circumstances, your rights under the Australian Consumer Law statutory consumer guarantees may be greater than your rights under the EGR Warranty Policy, in which case EGR will always honour your rights under the Australian Consumer Law statutory consumer guarantees.

Your Responsibilities

You must operate, maintain and care for your EGR product properly, in accordance with the instructions in the product's Owner's Manual/Fitting Instruction.

Purchase information will be requested and is essential to moving the claim forward. In addition, a serial number of the product being claimed will be required for products covered under the 3 year warranty period.

EGR must be contacted prior to attempting any resolution on a part to be claimed under this warranty policy. EGR will in turn activate a resolution in the form of a repair or replacement. No claim will be accepted until viewed and authorized by an EGR representative; inclusive of labour repair and subsequent damages.

If a replacement is provided, EGR request the original part be made available for return to EGR (if requested). EGR will arrange for the freight to be returned, whilst it is the claimant's responsibility to ensure the part is safely packed prior to transit.

Claims Prior to Fitment

For claims prior to fitment, it is EGR's customer's responsibility to examine the goods for defects. EGR must be notified of any defects, in writing, within 7 days of goods being received. If EGR's customer does not notify EGR within 7 days of delivery, that customer shall be deemed to have accepted the goods as being of merchantable quality and free from defects.

Expenses Associated With Claims Under The EGR Warranty Policy

In the case of subsequent damage, EGR will request a written quote be submitted in order to assess the repair. EGR will them authorize the repair to go ahead in writing on the condition that EGR is unable to warrant the work of a 3rd party repairer. EGR cannot guarantee that the full cost of repair work will be by EGR if the work is undertaken by EGR's customer prior to EGR's written consent.

In most cases, there will be no charge to you for expenses associated with making a claim under the EGR Warranty Policy. If there are circumstances that mean you may need to pay a charge, the charge will be discussed with you in advance.

Where Coverage Does Not Apply

Damage or failures resulting from:

  • Accident, theft or fire or illegal use.
  • Incorrect fitment of an EGR product to the vehicle.
  • Water ingress from floods or deep-water fording.
  • Scratches or surface rust caused by normal wear and tear, including but not limited to stone or other chips in paint.
  • Improper adjustment, repair, tampering, or modifications.
  • Overloading - permissible loads are covered in the products Owner's Manual/Fitting instruction.
  • What EGR reasonably considers to be a failure to operate, maintain and care for your EGR product properly, in accordance with the instructions provided in the product's Owner's Manual/Fitting Instruction.

Subject to s.259 (4), s.271 (2) and s.271 (4) and s.272 (2) of Australian Consumer Law, EGR excludes any and all liability for loss or damage for problems:

  • Unrelated to EGR's conduct;
  • Unrelated to the goods supplied by EGR; and
  • Caused by something independent of EGR after the goods have left its control.

* Your EGR Warranty period begins on the day your product is fitted, or 6 months after the product was sold by EGR, whichever date occurs first.
